SPHERE™ Terms & Conditions

1. Acceptance of Terms

By accessing or using SPHERE™, you agree to comply with these Terms and Conditions, the SPHERE™ Community Standards, Privacy Policy, Safety policies, and all applicable laws and regulations. If you do not agree, you must not create an account or use the platform.

2. Membership Eligibility

SPHERE™ is a 16+ platform. You must be at least 16 years old to create or use an account. By registering, you confirm that the date of birth and other information you provide are complete, current, and truthful.

SPHERE™ may refuse registration, restrict access, or close an account when the eligibility requirements are not met.

4. Age and Identity Assurance

To protect the community and apply age-appropriate safeguards, SPHERE™ may use proportionate age-assurance or identity-verification measures. Depending on the circumstances, this may include confirming a member's legal name, age band, mobile phone number, email address, location, or requesting a government-issued photo identification or another reliable verification method.

A self-declared date of birth or an ordinary payment transaction may not be sufficient proof of age by itself. SPHERE™ will seek to use privacy-conscious verification methods and will handle verification information in accordance with the Privacy Policy and applicable law.

Verification may be requested to establish eligibility, recover an account, investigate suspicious activity, prevent fraud or circumvention, enforce safety protections, or comply with legal obligations. Failure to complete a required verification may result in limited access, suspension, or termination.

5. Truthful Information and Age Misrepresentation

Members must not provide a false date of birth, false identity, false location, or other materially inaccurate registration information. SPHERE™ may review an account and request additional verification when information appears inaccurate, inconsistent, or deliberately misleading.

SPHERE™ may restrict, suspend, or terminate an account for false information or attempts to bypass age-based safeguards. An account may be permanently terminated when deliberate age misrepresentation or deliberate circumvention is established.

6. Account Responsibility

You are responsible for maintaining the confidentiality and security of your account credentials and for activity that occurs through your account. You must promptly notify SPHERE™ if you believe your account has been accessed without permission.

You may not sell, transfer, share, or permit another person to use your account in a way that defeats eligibility, verification, safety, or access requirements.

7. Member Conduct

Members must not post, upload, transmit, promote, or share content or activity that:

• is illegal, fraudulent, deceptive, or exploitative;
• promotes credible violence, threats, terrorism, or dangerous criminal activity;
• contains or facilitates child sexual exploitation or abuse material;
• contains non-consensual intimate or explicit content;
• harasses, bullies, stalks, abuses, or unlawfully discriminates against others;
• encourages suicide, self-harm, eating disorders, or other serious harm;
• infringes intellectual-property, privacy, publicity, or other legal rights;
• distributes malware, attempts unauthorized access, or interferes with SPHERE™ systems; or
• circumvents platform protections, enforcement decisions, or access controls.

8. Member Content and Ownership

You retain ownership of eligible content that you create and upload. You are responsible for ensuring that you have the rights and permissions necessary to post it.

By posting content on SPHERE™, you grant SPHERE™ a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, and technically adapt that content only as reasonably necessary to operate, secure, improve, and provide platform services. This license ends when the content is deleted from SPHERE™ systems, subject to reasonable backup, legal, safety, and evidentiary retention requirements.

9. Intellectual Property

SPHERE™, its platform design, software, branding, and associated materials are owned by or licensed to SPHERE Social Media Holdings LLC and are protected by applicable intellectual-property laws. These Terms do not grant permission to copy, misuse, impersonate, or commercially exploit SPHERE™ intellectual property.

10. Payments and Paid Services

SPHERE™ may offer membership verification fees, creator subscriptions, advertising services, event access, and other paid services through approved payment providers. Prices, taxes, refund eligibility, and payment terms presented at checkout apply to the purchase.

Fees may be changed for future transactions with appropriate notice. Unless expressly stated otherwise, a payment does not guarantee continued access when an account violates these Terms or applicable law.

11. Enforcement, Suspension, and Termination

SPHERE™ may remove content or restrict, suspend, or terminate accounts when reasonably necessary to enforce these Terms, protect members or the public, investigate misuse, comply with law, or preserve platform security and integrity.

The response may depend on the nature, severity, frequency, and surrounding circumstances of the violation. Serious safety violations may result in immediate action.

12. Privacy and Safety

Use of SPHERE™ is also governed by the SPHERE™ Privacy Policy, Community Standards, Member Protection Center, and other applicable safety notices. Those documents explain how information is handled and how platform safety rules operate.

13. Service Availability and Changes

SPHERE™ may update, modify, limit, or temporarily suspend all or part of the service for maintenance, security, legal, operational, or improvement purposes. SPHERE™ does not guarantee that every feature will always be available, uninterrupted, or error-free.

14. Third-Party Services and Links

SPHERE™ may link to or work with third-party services, websites, payment providers, or content. Their separate terms and privacy practices may apply. SPHERE™ is not responsible for third-party services outside its control.

15. Disclaimers and Limitation of Liability

To the fullest extent permitted by applicable law, SPHERE™ services are provided on an "as available" basis. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including any non-waivable consumer rights.

To the fullest extent permitted by applicable law, SPHERE Social Media Holdings LLC will not be liable for indirect, incidental, special, exemplary, or consequential loss arising from use of or inability to use the platform.

16. Applicable Law and Local Rights

These Terms operate subject to applicable law. Members may have mandatory rights under the laws of the country or region where they live, and nothing in these Terms is intended to remove rights that cannot legally be waived.

17. Changes to These Terms

SPHERE™ may update these Terms to reflect changes to services, safety measures, legal requirements, or business operations. When a material change is made, SPHERE™ will provide appropriate notice and update the effective or review date shown above. Continued use after the change takes effect constitutes acceptance where permitted by law.
